Clearance to Combustibles: The Requirement Nobody Checks Until It's Too Late
It looks fine from the room, which is exactly the problem. Where the required distances actually apply, and why remodels are the most common cause of a violation.
Clearance to combustibles is the least visible requirement in the whole trade and among the most consequential. Nothing about a violation is apparent from the living room — it is found in an attic, behind framing, or above a mantel — and the most common cause is not bad original construction but a later renovation nobody re-checked.
01What the requirement actually governs
Minimum distances between heat-producing components and anything combustible: the chimney's exterior where it passes framing, the appliance and its connector, and the finish materials around a fireplace opening. The distances come from the standard for masonry construction and from the appliance's own listing for manufactured units.
The listing point matters. A listed factory-built fireplace is approved at specified clearances because that complete assembly was tested at them — the permission belongs to the assembly, not to fireplaces in general.
02Why remodels create most of the violations we find
A chimney built with correct clearance in 1978 can be in violation today without anyone touching the chimney. Someone added insulation in the attic against the chase. Someone framed a bulkhead. Someone re-roofed and the new structure sits closer. Someone built a mantel deeper than the old one.
None of those jobs involved a chimney contractor, and none of them prompted a re-check. This is the mechanism, and it is why an inspection after any building work is worth more than an inspection on a schedule.
03The mantel rule that surprises people
A mantel shelf has a required minimum height above the fireplace opening, and the required height increases with how far the shelf projects from the wall. A deeper shelf must sit higher. Homeowners routinely specify a substantial deep mantel for looks and discover the constraint after it has been fabricated.

04Where insulation goes wrong
Blown-in or batt insulation packed against a chimney chase is a common and serious finding. It places combustible material in direct contact with a surface designed to be surrounded by air, and it is invisible from every occupied part of the house.
It is usually done in good faith during an energy upgrade. The insulation contractor is not looking for chimney clearances and the homeowner does not know to ask.
05How a violation is established
By physical access — attic, crawl space, or the framing where the chimney passes through. That is precisely the scope difference between a routine visual inspection and the deeper level, and it is the reason the deeper level exists.
You cannot establish clearance from the hearth, and a report that pronounces on it without having been in the attic has not checked it.
If you have had insulation added, a roof replaced, an attic finished, or a mantel changed since your last inspection, the clearance question is live again regardless of when you were last checked. It is the one requirement that a building project can violate without anyone involved realising it.
